Introduction

Welcome to Low Cost IT. Low Cost IT provides leading computer support and technical expertise, computer upgrades and repairs, Web Design, Web Hosting, Offsite back up, Network support, Antivirus & Spyware removal and an online store. Low Cost IT is a cash based no account business. By implementing this model we are able to charge a low hourly rate for support and discounted hardware. Unless explicitly stated otherwise, any new Products and Services (as defined below), shall be subject to these Terms and Conditions.
Low Cost IT makes available a variety of products and services through the Low Cost IT Website (collectively, the "Products and Services") subject to these General Terms and Conditions ("Terms and Conditions"). Please read them carefully.
By agreeing to the following Terms & Conditions you are not entering into a contract. All business dealings can be ceased at any time.
These Terms and Conditions must be read and signed by a manager, owner or director of company or in the case of an individual by him or her self.

1. Obligations
1.1. payment to Low Cost IT at the current services rates of Low Cost IT

2. Charges
2.1. Additional hardware and other materials supplied by Low Cost IT are not part of the standard rates and will be charged to the customer according to Low Cost IT normal pricing policy.
2.2. GST, stamp duty, customs duty and other taxes where and if applicable, shall be paid by the customer and the customer shall indemnify Low Cost IT against any such charges.
2.3. Charges for onsite support: (Please see Services page for pricing). Minimum 1 hour support. Additional time billed in 15 minute intervals.
2.4. Charges for in store support: (Please see Services page for pricing) Minimum 30 mins. Additional time billed in 15 minute intervals.
2.5.Term of payment is strictly COD for cash based, and 7-14 for approved account application depending on approval, please check if unsure. Low Cost IT will charge a $25.00 per month fee for any accounts overdue.
2.6. Accounts which are sent to a collection agency for collection will have all legal costs and commissions added to the claim.

3. Customer Obligations
3.1. Allow Low Cost IT immediate full and free access if and where required to equipment to provide services.
3.2. Sign acceptance of work before any services can be carried out at each instance.

4. Liability
4.1. The customer shall be responsible for insuring any goods sent to Low Cost IT for repairs.
4.2. While the utmost of care is taken by Low Cost IT with regards to customer data, Low Cost IT will not be responsible for data loss. Low Cost IT recommends full backups of all systems to ensure protection from data loss.

5. Waiver
5.1. The failure, delay, relaxation or indulgence on the part of Low Cost IT at any time or from time to time in exercising any power of right given to it under any agreement between Low Cost IT and the customer or to require at any time performance by the customer of a provision of any such contract shall not be construed as a waiver of the provision or affect the validity of that contract or any part thereof nor the right of Low Cost IT to thereafter enforce each and every provision of any such contract and any single exercise of a power or right does not preclude any further exercise of it or the exercise of any other power or right under such contract.

6. Limitations
6.1. This agreement does not include the cost of hardware, software or any other materials that may be supplied by Low Cost IT while providing services.

7. Confidentiality
7.1. Low Cost IT and the customer irrevocably agree that they shall not disclose or otherwise reveal directly or indirectly to any third party, any confidential information provided by one party to the other, or otherwise acquired, particularly, contract terms, product information, or manufacturing processes, prices, fees, financing arrangements, schedules, and information concerning the identity of sellers, producers, buyers, dealers, borrowers, brokers, lenders, distributors, developers, manufactures, technology owners, or their representatives, and specific individual names, addresses, principals, or telex / fax / telephone numbers, references, product or technology information, and / or all other information, advised by one Low Cost IT or the Customer to another as being confidential or privileged, without the prior specific written consent of Low Cost IT or the Customer providing such information. Neither Low Cost IT nor the Customer may be held liable, if, through no action or fault of the later, any of the above mentioned confidential information is released by the owner or a third party.

8. General
8.1. This agreement shall be governed by and construed in accordance with the laws of and applying in the state in which the agreement was entered into.
8.2. These terms and conditions together with the schedule indicated overleaf contain the entire agreement and agreement may only be amended by an instrument in writing signed by Low Cost IT.
8.3. Nothing contained in this agreement shall be construed as an express warranty or representation of any kind on behalf of Low Cost IT and it is agreed that so far as the law permits all conditions and warranties which might be implied on the part of Low Cost IT are hereby negative and excluded.

9. Secure Access Details
9.1. Other than by use of the website of your valid username and password or via use of your biller code, or any other form of secure access details provided to you, you will not attempt to gain access to any reports, documents, statements, registers or any other information contained on the site without having the express authority from Low Cost IT
9.2. Your secure Access Details must be kept safe. You must ensure that you and each person you authorise to use it do not tell or show those details to any other person

10. Disclaimers and Limitations of Liability
10.1. While Low Cost IT has made every effort to ensure that information both provided directly to you or obtained and available from the website is free from error, Low Cost IT does not warrant the accuracy, adequacy or completeness of that information. All information is subject to change without notice. Low Cost IT recommends that you seek independent legal advice before acting upon any material contained on the website. Low Cost IT does not guarantee that the website will be free from viruses, or that access to the website will be uninterrupted. You are solely responsible for your own security measures.

11. Indemnity
11.1 You will be liable for and indemnify Low Cost IT, its employees, offices, servants, agents and contractors and each of them jointly and severally against any loss, damage, expense or cost of any nature (including, without limitation, full solicitor and client legal costs on an indemnity basis) that any of them incurs or may incur (whether directly, indirectly, consequentially or otherwise) arising out of your use of this website or any of its contents or by use of Low Cost IT Services or from any breach by you of any of these terms and conditions.
